IV All-Russia Conference of Commissioners on the Protection of the rights of entrepreneurs was held in Moscow

IV All-Russia Conference of Commissioners on the Protection of the rights of entrepreneurs began working on December 8.

The event was attended by the Commissioner under the President of the Russian Federation on protection of the rights of entrepreneurs Boris Titov, Minister Mikhail Abizov, procurement Ombudsman Sergey Gabestro, Ombudsman on electronic commerce and the provision of public and municipal services in electronic form Iliia Dimitrov, Head of the control of public procurement of the FAS of Russia Tatiana Demidova, as well as by representatives of federal authorities and experts mandated to protect the rights of entrepreneurs in the regions of Russia.

At the plenary session on "The priorities of work of specialists authorized for the protection of the rights of entrepreneurs in the regions of Russia" federal business ombudsman Boris Titov made a presentation. He summarized the work of the institution of Plenipotentiaries in 2014, and spoke about the prospects of its development and the goals and objectives for the future.

Among the key questions of the conference are the issues relating to doing business, work of ombudsman institution in the municipalities, implementation of the Law on Public Procurement, practice of proceedings in arbitration courts and work with applications on unfounded criminal prosecution.

The conference included opened sessions, workshops, panel discussions and round tables.

The round table on the implementation of the provisions of the Federal Law № 44-FZ "On the contract system in the procurement of goods, works and services for state and municipal needs" took place on December 8. It was moderated by the procurement Ombudsman Sergey Gabestro and the Ombudsman on electronic commerce and the provision of public and municipal services in electronic form Iliia Dimitrov.

The report "A review of disputes in the area of electronic commerce, identified legislation bottlenecks, system proposals to improve the contract system" was presented by Iliia Dimitrov.

According to him, the principles and objectives declared by the Federal Law # 44-FZ, for which, strictly speaking, the contract system was created in Russia, have not yet been fully achieved in the area of procurement of goods, works and services for state and municipal needs. “Until now, budget funds spending to purchase is still high, the level of competition in the auction is not high enough, and the level of transparency of the procurement itself is low. Analysis of available data shows that this may be due, inter alia, to the fact that the positive potential of electronic procedures and services in this area is not sufficiently realized, "- said the expert.

In his speech, the Ombudsman on electronic commerce and the provision of public and municipal services in electronic form focused on the issue of the valuation of costs on public procurement, as well as noted the tendency of municipal customers to avoid competitive methods of determining suppliers, and especially electronic auctions and a common way of municipal customers evasion from determining suppliers through electronic auction - an artificial unification of several orders in one lot.

"In general, we can say that customers often abuse the right to contest," - said the expert, stressing that their actions are sometimes not aimed at identifying the most profitable proposal and pursue the goal of attracting an already "known" supplier and usually at the expense of economic efficiency of procurement, which implies an obvious restriction of competition and the waste of public funds.

The first day of conference sessions on business was related to the verification activities. On the discussion were submitted issues relating to problems of control and supervision over the activities of entrepreneurs. 

The second day was devoted to topical issues of entrepreneurship in Russia, in the framework of which took place expert consultations of the Commissioner under the President of the Russian Federation on protection of the rights of entrepreneurs.

The Conference continues its work until December 10.
